LEGAL INFORMATION

 

The “Company” means Dynasty Gold Legacy LTD incorporated under the laws of the Marshal Islands, having its registered office at TRUST COMPANY COMPLEX
AJELTAKE ROAD, AJELTAKE ISLAND, MAJURO, MARSHALL ISLAND, MH 96960, with registration number 104452.

The “Website” shall mean the Internet website operated by the Company accessible at www.dynasty.gold.

The "Client" shall mean a person who is 18 years or older and or an entity who/ which registers on the Website and who places an order via the website.

The “Bars” or “coins” shall mean whenever used generically gold bars/coins or a combination of the two sold by the company to the Client.

Any reference to the masculine contained herein shall be construed as including a reference to the feminine.

If you do not agree to any of the terms set forth herein, you may not use the Website or engage in transactions with Company. These disclosures and Terms are subject to change at any time without notice and it is your responsibility to review these Terms regularly to ensure that you are aware of any changes.

 

PARTIES


 

The Client under the contract is you. The supplier under the contract is the Dynasty Gold Legacy LLC trading as Dynasty Gold Legacy. Registered Address: TRUST COMPANY COMPLEX, AJELTAKE ROAD, AJELTAKE ISLAND, MAJURO, MARSHALL ISLAND, MH 96960, registered in Marshall Islands with number 104452.

 

INVESTMENT ADVICE


 

We are not authorized by a Financial Conduct Authority and cannot give advice comparing precious metals with regulated investments. We also cannot provide advice on any potential tax implications of you entering into the contract with us. It is a condition of the contract that if you need investment or tax advice in relation to Products or metal, you must rely on your own financial, tax and/ or accounting advisers.

 

PUBLISHING ACTIVITIES

 

All commentary and analysis contained within Company’s emails, publications, videos or podcasts, and Website are provided for general educational purposes only. In no event is this information tailored to the specific needs of any person or group, and it does not constitute investment advice.

 

 

DELIVERY

 

A) Ownership of the Products shall pass to you on Delivery provided we have received the full value

B) Delivery/ Pick-up of Products shall be at your own cost. Delivery location will be in Dubai, United Arab Emirates.



C) We shall not be liable for any loss suffered by you caused directly or indirectly by any delay in the delivery of the Products, nor shall any delay entitle you to terminate or rescind this Contract.

 

STORAGE SERVICES

 

A) You can choose to place Products into allocated Storage which we can arrange on your behalf and at your cost.

B) Storage will be charged depending on the Products purchased and as illustrated in the Storage Agreement between the Parties.

C) Conditions for Storage are contained in the Storage Agreement and shall form part of this Contract.

 

RISK/TITLE

 

A) The Product is at your own risk once signed for as Delivered

B) Ownership shall not pass to you unless to you until such time as we have received in full the Purchase Price in respect of those Product

C) AWARENESS

Due to the unpredictable nature of commodity markets, the buying or selling commodity products such as the Bars/coins comprises a high degree of risk and might not be suitable for everyone. The Client declares that he/she has read and understood these TCs and is aware of the nature and extent of his/her rights and risks when purchasing such products.

 

LIMITS OF LIABILITY AND FORCE MAJEURE

 

The role of the Company is limited to that of executing the instructions received from the Client. The Company does not advise the Client on the purchase or sale of gold and Client is encouraged to seek proper advice from licensed financial advisors.

The Company does not have the competence to and cannot guarantee that the Client will realize any capital gain upon the eventual resale of the Bars/coins purchased.

The Company may in no way be liable in case of telecommunication means failure, whether the failure is due to the server hosting the Website, or any other website, non-receipt of emails, photocopies or letters sent by the Client.

All data accessible from the Website is posted for indication purposes and is not to be taken as a substitute for the information issued by official bodies.

The Company assumes no liability for delays or failures in the performance of its obligations if such delay or failure is due to unforeseen events beyond its control and which are deemed to constitute force majeure. Such causes that might terminate or suspend the obligations of the Company for reasons due to Force Majeure include inter alia, Acts of God, floods, lightning, fire, earthquakes, labor disputes, shortages, rationing, energy failure, war, terrorism, riots, embargoes, governmental actions, accidents affecting the production and storage of Dynasty Gold’s products, total or partial stoppage of supply, failure of the carrier, insurrections, energy suspensions, machinery breakdown, total or partial strike, administrative decisions, epidemics/pandemics, explosions, third party actions, and any external event that is likely to delay, prevent or make prohibitively expensive the implementation of the Company's commitments and obligations.

The occurrence of an event constituting force majeure shall be immediately notified to the Client.

 

BUY BACK

 

We are NOT obligated to purchase your metals back from you.

 

CANCELLATION


 

You have NO statutory right to cancel the contract or return your Products if you change your mind or receive a refund. This is because the prices of the Products and Services we supply are dependent on fluctuations in financial markets.

 

GENERAL


 

A) If any provision of this Contract is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly unenforceable or unreasonable it shall to the extent of such unenforceability or unreasonableness be deemed severable and the remaining provisions of this Contract shall continue in full force and effect.


B) Any waiver by us under this Contract regarding your breach of, or default under, any provision of this Contract shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other terms of this Contract.


C) This Contract shall not be enforceable by any person not a party to it by virtue of the Contracts (Rights of Third Parties).


D) The formation, existence, construction, performance, validity and all aspects of this Contract shall be governed by Marshall Islands law and the parties submit to the exclusive jurisdiction of the Marshall Islands courts.

 

FEES AND COMMISSIONS

 

The Bars/coins are provided to the client at spot price at the date of pickup/delivery by Dynasty Gold minus a management fee.

 

The purchase price of a single purchase contract can be paid as follows:

 

1. Immediately pay the full purchase amount

2. Down payment of minimum US$100.00 and the remainder paid in installments;

3. Down payment of minimum US$100 and the remainder through contract recommendations within our accumulation model, and with an active membership.

For every contract, an applicable management fee will be charged for contract processing and administration. The management fee is to be paid by the Client after completion of each contract phase (Phases 1, 2, 3 and 4) as follows: $5 for Phase 1, $15 for Phase 2, $75 for Phase 3 and $150 for Phase 4.

 

The management fee is charged for the following services:

• Management of the purchase contract

• Control of all payments and recommendation services;

• Electronic communications to the Client;

• Management of Client’s referrals

The delivery costs for your gold orders are not included in the management fee.

 

YEARLY MEMBERSHIP

 

The yearly membership fee of US$49 is charged for the following services:

• Create and maintain a Client account;

• Providing multilingual Client support service;

• Providing of a 2FA Wallet

• Implementation of special Client support measures such as regular virtual presentations and further training measures.

All Client’s contracts will remain active as long as his/her membership is active. The grace period to renew the yearly membership is 48 hours.

 

REFERRAL PROGRAM

In order to participate in the referral program, Dynasty Gold Members must agree to the referral program terms.

Throughout this document, the following definitions apply:

Referral Links should only be used for personal and non-commercial purposes and should only be shared with personal connections who would appreciate receiving these invitations. Referral Links should not be published or distributed where there is no reasonable basis for believing that all or most of the recipients are personal friends; for example, on coupon Websites or with services such as Wikipedia. Referrers are prohibited from spamming anyone with referral invitations. This includes mass emailing, texting or messaging people you do not know or using automated systems or bots through any channel to distribute a Referral Link. Referrers are prohibited from paying to advertise their Referral Links.

Please note that you will be rewarded only if (i) the Referred clicks on your referral link to create a valid Dynasty Gold account that complies with our Terms and if (ii) the Referred completes a Qualifying Purchase. The Qualifying Purchase must have the minimum total value indicated for each gold plan and must be a completed purchase within our system.

You must ensure the Referred uses your correct referral link as later adjustments or changes of sponsorship will not be allowed.

The Referrer will indemnify and hold Dynasty Gold, its directors, officers, employees, shareholders, agents, and successors harmless, from and against any claims that may arise from any unlawful forwarding or sharing of the Referral Link.

 

Dynasty Gold may suspend, terminate, or change the terms and requirements of the Referral Program at any time and for any reason.

 

 

APPROPRIATE USER CONDUCT AND USE

 

We reserve the right to refuse, void, or liquidate orders from customers who fail -- or have previously failed -- to honor their commitments, who violate our policies, who attempt to circumvent our promotional conditions, or where potentially fraudulent activity is detected.

 

Eligibility requirements for the Dynasty Gold Referral Program

 

By using this Website, you are communicating with us electronically and consent to receive communications from us electronically. You agree that all electronic communications – including notices, disclosures, cancellations, and policies – shall satisfy any legal requirements that such communications be in writing.

On the platform, the Referrer with his personalized invitation link can only recommend friends, family members or colleagues ("friends") whom the Referrer knows personally and with whom he has had a personal conversation. Users may not use the program in order to violate applicable legal provisions, violate the rights of third parties or to carry out activities that are annoying, harmful and untrue or contrary to the purpose of the program.

This includes, but is not limited to, a general prohibition on the publication and promotion of referral links on websites of any kind, blog pages including social networks and messenger services, in emails and newsletters that contain the referral link to people other than personal known friends, i.e. make the ref link accessible to people whom the Referrer knows personally and whom he has personally contacted. Under no circumstances may a Referrer transfer or sell a personalized referral link or user account to a third party.

If a recommending person sends a personal link to a recommended customer by email, the email must be created and sent personally, as is appropriate and customary for communication with friends, colleagues and family members. Sending bulk emails, sending emails to strangers or other advertising of a personal link in a way that represents or could represent unwanted commercial emails or "spam" is expressly prohibited and can lead to terminate the account of the Referrer and deactivate the personal link without notice. Dynasty Gold does not tolerate spam.

Referrers who violate legal provisions, including laws against spam, release the company from all liability for claims, costs and expenses incurred by such spam.

It is expressly forbidden to change, use, sell, falsify, re-adjust or disassemble presentation documents, texts, audio clips, advertising materials, videos or any content protected by Dynasty Gold as well as HTML or other computer software that is accessible on our website, to copy.

We reserve the right to exclude users from participating in the program at any time if we believe in good faith that they have violated any of the aforementioned terms.

 

ELECTRONIC COMMUNICATIONS

 

By using this Website, you are communicating with us electronically and consent to receive communications from us electronically. You agree that all electronic communications – including notices, disclosures, cancellations, and policies – shall satisfy any legal requirements that such communications be in writing.

 

COPYRIGHT AND TRADEMARKS

 

Intellectual property rights in any and all content that appears on the Website, including but not limited to the copyright, trademark, patent, trade dress, trade secret, know-how, and proprietary information, such content including but not limited to: information, articles, graphics, images, video, audio, logos, slogans, text, data, and photographs (“Content”), are the property of the Company. By using the Website, you agree not to use or exploit any Website Content, without written permission from the Company.

 

YOUR ACCOUNT

 

It is your responsibility to maintain the confidentiality of your account (including username and password) and to restrict access to any computer you use to access your account or complete a transaction. By using our site, you accept full responsibility for any activity which occurs on your account and release the Company from any liability therefor.

 

You are fully responsible for any disclosure of your Dynasty Gold account details, passcodes on any device or devices or other security details relating to your account with us and Wallet to any other person, even if such disclosure is accidental or unauthorized. You are required to bear all risks and consequences of your Dynasty Gold account being used by unauthorized persons or for unauthorized purposes.

 

WALLETS

 

You acknowledge and accept the risk of incurring any loss which may arise from or in connection with unauthorized transactions made on your Wallet(s). You undertake to be liable for all transactions incurred using the Wallet(s) whether or not the transactions were properly authorized by you. It is your responsibility to take security measures to protect the use of your Wallet(s).

 

LOSS, THEFT OR MISUSE

 

You must notify us straight away and request that we deactivate your account by emailing our Customer Service specified in your back office if you notice or suspect any loss, theft, unauthorized possession, control or use of your account or if you believe someone else has used your account or has discovered the security details of your account or the security of your account or Wallet(s) or Eligible Device has been compromised in any other manner.

 

OBLIGATIONS OF THE PARTICIPANT

(1) When using the Dynasty Gold Internet platform, you are prohibited from violating the rights of third parties, harassing third parties or otherwise violating applicable law or morality. In particular, you undertake to refrain from the following actions:

Spreading statements with offensive, harassing, violent, glorifying violence, inflammatory, sexist, obscene, pornographic, racist, morally reprehensible or otherwise offensive or prohibited content;

Insult, harass, threaten, slander, slander, inconvenience other participants or Dynasty Gold employees;

Spying on, disclosing or disseminating personal or confidential information of other participants or Dynasty Gold employees or otherwise disregarding the privacy of other participants or Dynasty Gold employees;

Spread false allegations about race, religion, sex, sexual orientation, origin, social status of other participants or Dynasty Gold employees;

Spying on, disclosing or disseminating Dynasty Gold confidential information;

Spread false allegations about Dynasty Gold;

Pretend to be an employee of Dynasty Gold or an affiliate or partner of Dynasty Gold;

Use any copyrighted images, photographs, graphics, videos, music, sounds, text, trademarks, titles, labels, software or other content and labels without the consent of the copyright owner(s) or permission of contract, law or regulation;

Distribution of statements with advertising, religious or political content;

Use of prohibited or illegal content;

The exploitation of programming errors (so-called bugs);

Taking measures that may result in excessive server load and/or massively affect the operation of other participants;

Hacking or cracking and the promotion or encouragement of hacking or cracking;

Distribution of counterfeit software as well as the promotion or stimulation of the distribution of counterfeit software;

Upload files that contain viruses, Trojan horses, worms or data that has been destroyed;

Using or distributing "car" software programs, "macro" software programs, or other "cheat utility" software programs;

Modify the Dynasty Gold Service or any portion thereof;

Use software that enables "data mining" or otherwise intercepts or collects information related to the Service;

Interfere with transmissions to and from the Service Servers and the Website Servers;

Penetrate Dynasty Gold's service servers, data servers, or Web site servers.

(2) Dynasty Gold expressly reserves the right to immediately block the online account of the participants if one of the obligations regulated in (1) or any other applicable law is violated when using the Internet platform.

 

LINKS TO THIRD-PARTY WEBSITES AND CONTENT

 

This Website may include links to third-party websites or services. The Company does not review such links nor does their presence on the Website constitute any endorsement thereof. By using the Website, you acknowledge that we are not liable for any third-party content, products, or services, nor for the privacy practices of such websites.

 

 

SERVER AVAILABILITY

The Internet platform is available 24 hours a day, seven days a week with an annual average availability of 97.5%. Excluded from this are downtimes due to maintenance and software updates as well as times during which the service cannot be accessed via the Internet due to technical or other problems beyond Dynasty Gold's control (force majeure, fault of third parties, etc.). In order to use the Internet platform to its full extent, you must use the latest (browser) technologies or enable their use on your computer (e.g. activation of JavaScript, cookies, pop-ups). If you use older or not generally used technologies, you may only be able to use the services of Dynasty Gold to a limited extent.

 

TRANSLATIONS

 

The original English version of this Agreement may have been translated into other languages. The translated version of this Agreement is a courtesy and office translation only. In the event of a dispute about the contents or interpretation of these terms and conditions in this Agreement or in the event of a conflict, ambiguity, inconsistency, or discrepancy between the English version and any other language version of this Agreement, the English language version will apply, prevail, and be conclusive and binding. The English version will be used in legal proceedings.

 

MISCELLANEOUS

 

(1) Your access to the Dynasty Gold internet platform and services is at your own risk. Dynasty Gold has the right, without prior notice or liability, to make future changes to the Internet platform and the free services offered by Dynasty Gold.

(2) Dynasty Gold reserves the right to restrict or terminate your use of the Internet Platform if Dynasty Gold believes that you are in breach of any contractual obligation or breach any law, or otherwise misuse the Internet Platform.

(3) Dynasty Gold does not warrant that that it is legal under your jurisdiction to use or promote Dynasty Gold services or participate in any Dynasty Gold activities; that access to the Internet platform is error-free, trouble-free, timely or secure at all times and that faults are rectified; that information is complete, accurate or reliable;

(4) Dynasty Gold reserves the right to transfer, assign, sublicense or pledge, in whole or in part, all rights and obligations under these Terms of Participation to any third party without notifying you as a User about it and without obtaining your consent.

 

UPDATES TO THE TERMS

We can update these terms at any time without prior notice. Continued participation in the Program after any modification shall constitute consent to such modification.

 

SEVERABILITY

 

If any provision in these terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity and enforceability of the remaining provisions.
